General travel conditions

§1 Group tour definition

Group tours are not generally considered a “package tour,” but a customized offer agreed upon between one person on behalf of a number of people and Naturhelten.dk.

§2 Travel price

The travel price includes the services mentioned in the confirmation that are included in the trip.
The price is conditional on the number stated on the order confirmation. Reducing the number of travelers will normally always mean an increase in the price. It is important that the group’s contact person is aware that the price will normally increase if the group’s number is reduced, unless otherwise notified in writing. See also section on cancellation cover §10. Special agreements, based on the group’s special wishes, must – in order to be valid – appear directly in the agreement.

§3 Payment

3.1 Deposit
The deposit must be paid no later than 10 days after the order confirmation has been sent to the group’s contact person.
The deposit is normally DKK 700 per paying person for trips with a price below DKK 1500 per person, and DKK 1300 per paying person for trips with a price below DKK 2500 per person. The deposit is normally DKK 1600 per paying person for trips with a price below DKK 4000 per person, and DKK 2000 per paying person for trips with a price up to DKK 6000 per person. The deposit for trips over DKK 6000 per person is determined by the travel consultant. The deposit may deviate from the above in specific cases. If this is the case, it will be stated on the order confirmation. In the event that the deposit is not paid within the specified deadline, Naturhelten.dk reserves the right to cancel the agreement.

3.2 Balance
The balance must be received by Naturhelten.dk no later than 10 weeks before the departure date.
If the balance is not paid on the agreed due date, Naturhelten.dk has the right to cancel the agreement – alternatively charge a reminder fee of DKK 100. In that case, the matter is regarded as a cancellation, which means that the rules on cancellation in §8 come into force.

3.3 Final settlement
If, after the final payment/settlement, changes occur that result in extra invoicing or refunding, the balance must be received by Naturhelten.dk before departure.

3.4 Electronic payment
An administration fee of DKK 30 is charged for electronic invoices.

3.5 Name list
The name list is an important part of the workflow between Naturhelten.dk and our partners both at home and abroad. The group must therefore submit a correctly completed name list within a given deadline, which is stated on the order confirmation. If the deadline for submitting the name list is not met, a fee of DKK 200 will be charged. The name list must be identical to the names in the participants’ passports.

§4 Agent reservation for pure air travel

When purchasing only air travel, Naturhelten.dk acts as an agent for the airline and is therefore only a mediator of the flight ticket. Naturhelten.dk does not sell the flight tickets in its own name and thus only receives the customer’s payment for the purchased flight tickets on behalf of the airline.
The airline is the customer’s contracting party, and it is therefore solely the airline that is responsible for the correct implementation of the transport agreement. Naturhelten.dk is only a mediator of the transport service, and is as a result not responsible for delays, cancellations, the airline’s bankruptcy, other breach or lack of fulfillment of the transport agreement entered into between the customer and the airline.
The transport takes place in accordance with the Montreal and Warsaw Conventions and EU Regulation 889/2002, which limits the airlines’ liability for compensation in the event of death or injury and in the event of destruction, loss or damage to baggage, as well as in the event of delay, cancellation or denied boarding. Read more about these under § 16.

§5 Payment of sports/theater tickets etc.

In the event of cancellation, there will normally be no refund on the above-mentioned services.
Fees for, among other things, theater tickets, entrance fees to sports events and the like mean that the price printed on the ticket is lower than the price charged to the group. This is due to fees to agents, ticket offices, etc.

§6 Professional program

The program should be ordered well in advance. The latest order for the program is normally stated on the order confirmation. Unless otherwise stated, payment will be charged for the individual program items. Payment can be both per person and per group. If the group reserves a program or program items less than 12 weeks before departure, a rush fee of DKK 850 per program item will be charged in addition to the stated price for the desired services.
If the group cancels already confirmed program items, the group will always be charged a fee to cover costs in connection with ordering the program. The total fee is a minimum of DKK 850 per program item, however, a maximum of the total price for the program item in question.

§7 Price changes after the agreement has been entered into

Reservations are made for price changes after the agreement has been entered into or the price list has been published. As previously mentioned, the prices are based on the number of participants as well as a number of other services. However, Naturhelten.dk is only entitled to increase the price agreed for the trip as a result of changes in:

  1. Number of participants
  2. Transport costs, including changes in fuel prices
  3. Taxes, duties or fees for certain services, such as airport, port, landing or take-off fees.

In the event of changes in the price of the trip, the group will be notified no later than 20 days before departure.

The price can be increased by a maximum of 8% of the package tour price. If the increase is more than 8% of the package tour price, the group will be entitled to cancel the agreement.

In the event of price reductions as a result of changes in the above conditions, the group is entitled to a price reduction that corresponds to the price reduction that the changes entail. In this connection, Naturhelten.dk is entitled to deduct costs associated with the refund to the traveler.

§8 Transfer of the trip

Individuals can transfer a trip to another person who meets the requirements set for the trip, including passport, visa and vaccination regulations, up to 6 weeks before departure. The transfer is associated with an administration fee of a minimum of DKK 850.
Naturhelten.dk has the right to refuse transfer of the trip if this is not possible, for example, due to the provisions of the transport companies and/or authorities used.

§9 Cancellation by individuals or the group

As mentioned under §2, the price depends on the number of participants, which is why cancellation by individuals, in addition to the conditions below, normally means that the remaining part of the group will have a higher price than that stated in the order confirmation.
Cancellation and change means:

  • Cancellation of the entire trip.
  • Withdrawal of travel participants.
  • Change of travel route, destination or departure date.

Below are our cancellation and change rules:

  • In the event of cancellation or change more than 6 weeks before departure, the deposit paid is lost.
  • In the event of cancellation or change less than 6 weeks before departure, the entire price of the trip is lost.

§10 Cancellation in the event of acts of war, natural disasters, etc. at the destination

The group can cancel a trip free of charge if, within a period of 14 days before departure, acts of war, natural disasters, life-threatening and infectious diseases or other comparable events occur at the destination or in the immediate vicinity.
In such cases, the group will be refunded all amounts paid in accordance with the agreement.
However, the above rules do not apply if the group knew or should have known about the event in question, or special risks when ordering. The same applies if the event is generally known.

The group cannot cancel the trip free of charge earlier than 14 days before departure. In that case, the general cancellation rules apply. Naturhelten.dk can cancel earlier if it is associated with significant economic risks to wait and see whether the group decides to cancel or not.

The above conditions must be established or documented in a sufficiently objective manner, e.g. by the Ministry of Foreign Affairs, which must advise against entry to the destination in question. Rumors etc. in no way meet this requirement.

§11 Cancellation due to illness, etc.

The group or individuals in the group can secure the basic price paid by taking out cancellation insurance, which covers cancellation in the event of acute illness or serious injury that requires hospitalization, doctor-ordered bed rest or what can be equated with this, with the traveler himself, spouse, cohabitant, parents, siblings, parents-in-law, children, grandchildren, step-parents, step-siblings and grandparents. The cancellation insurance is not valid in the event of pregnancy, overexertion, mental illnesses or deterioration in chronic diseases. Cancellation insurance is voluntary. Cancellation insurance costs 4% of the price of the trip per person if the entire group takes out cancellation insurance, otherwise the insurance costs 6% of the price of the trip. However, a minimum of DKK 50 per person in both cases. Cancellation insurance is taken out at the same time as payment of the deposit. Cancellation must be notified to Naturhelten.dk without undue delay and BEFORE the group’s departure. The cancellation is only accepted in the event of medical documentation on the GOUDA Travel Insurance-approved form, which is sent by Naturhelten.dk. Medical documentation must be sent no later than 8 days after returning home, and the fee for the declaration rests with the traveler. The premium will not be refunded regardless of the reason.

§12 Failure to appear for the trip, missing passport/visa, vaccination, etc.

It is the traveler’s own responsibility to seek information about applicable rules for passport, visa and vaccination regulations. If the participants or individuals do not have a Danish passport, the group is encouraged to contact the respective consulate/embassy before booking the trip to seek information about the entry regulations/transit regulations that apply to the individual trip. The group is responsible for acquiring the necessary passports, visas and vaccinations etc. for the trip. If the participants have not taken care of the above in due time or otherwise fail to appear for the trip, this is regarded as a cancellation, and the price of the trip is therefore lost.

§12b Failure to appear for parts of the trip

If the traveler does not wish to use parts of the ordered travel arrangement, this must be notified to Naturhelten.dk as soon as possible and before departure. If the traveler fails to appear for the start of the trip, this is considered a cancellation of the entire trip and other ordered arrangements. This does not entitle to a special discount in the sales price or refund. Any changes to, or cancellations of parts of the ordered arrangement are per request and may result in additional costs.

§13 Changes to the travel agreement from Naturhelten.dk’s side before departure

Should Naturhelten.dk find it necessary to make changes to the travel agreement before departure, the group will be notified as soon as possible.
Naturhelten.dk has the right to cancel the trip if:

  • the cancellation of those registered for the trip is less than the minimum specified in the agreement or in these travel regulations, and the group is notified within a reasonable time.
  • cancellation or non-fulfillment is due to external circumstances that Naturhelten.dk, or someone Naturhelten.dk is responsible for, could not have foreseen with reasonable care when the agreement was entered into or have avoided or mitigated.
  • there are fewer than 35 participants on car-sharing buses.
  • the cancellation is due to force majeure or force majeure-like circumstances.

Naturhelten.dk has the right to make changes to the travel agreement if:

  • the transport company confirmed in the travel agreement introduces time changes.

§14 Naturhelten.dk’s responsibility for the implementation of the trip

Naturhelten.dk is responsible for the trip confirmed in the order confirmation.
If the group discovers defects along the way or at the destination, the group must IMMEDIATELY notify the supplier in question or Naturhelten.dk’s local partner, which is stated on the group’s voucher. If the problem is not resolved satisfactorily, the group must contact Naturhelten.dk immediately so that Naturhelten.dk has the opportunity to remedy the defect within a reasonable time. If the group does not immediately notify the supplier in question or Naturhelten.dk of any defects, any claims in this connection will be FORFEITED
If remedy is carried out within a reasonable time and without significant inconvenience to the group, claims for compensation cannot be made against Naturhelten.dk. If a defect is only notified after returning home, the right to object is lost. A claim can only be made if the group has written confirmation that defects have been made aware of to Naturhelten.dk, hotel, carrier etc. Any complaint must be submitted to Naturhelten.dk no later than 7 days after returning home. Otherwise, the right to object is lost. Naturhelten.dk is responsible for defects, unless

  • the defect is due to irrelevant third parties
  • the defect is due to external circumstances that Naturhelten.dk or someone Naturhelten.dk is responsible for could not have foreseen with reasonable care when ordering.
  • the defect can be attributed to force majeure or force majeure-like circumstances.

§15 The group’s responsibility and duties

Upon receipt of documents/travel documents etc., it is the group’s responsibility to check that the services and conditions confirmed by Naturhelten.dk are in accordance with what has been ordered.

§16 Limitation of liability in accordance with international conventions

Naturhelten.dk’s liability for defects as well as personal injury and property damage is limited to the compensation amounts stipulated in the international conventions that apply to service providers used by Naturhelten.dk in the implementation of the trips set out in this program.
For international air transport, liability is limited in accordance with the Warsaw Convention.
For international rail transport, liability is limited in accordance with the COTIF/CIF convention.
For international sea transport, liability is limited in accordance with the Athens Convention.

The limitations on the maximum compensation under the Warsaw and Montreal Conventions are set at:

  • In the event of passengers’ death or injury: 113,100 SDR – if the airline can prove that it has not acted negligently or improperly, or if the incident is due to a third party’s negligent or improper behavior
  • In the event of damage caused by delay in passenger transport: 4,694 SDR
  • In the event of destruction, loss, damage or delay of baggage: 1,131 SDR

The limitations on the maximum compensation under the Athens Convention and EU Regulation 392/2009 are set at:

  • In the event of passengers’ death or injury: 250,000 SDR to 400,000 SDR – depending on the cause of the injury and the carrier’s demonstrated fault
  • In the event of destruction, loss or damage to hand baggage: 2,250 SDR
  • In the event of destruction, loss or damage to vehicles, including baggage in or on the vehicle: 12,700 SDR – the carrier is only liable for damage caused due to errors on its part
  • In the event of destruction, loss or damage to baggage other than hand baggage and vehicles: 3,375 SDR

So-called “valuables” are not replaced according to the rules.

The limitations on the maximum compensation under the COTIF convention and EU regulation 1371/2007 are set at:

  • In the event of passengers’ death and injury: 175,000 SDR
  • In the event of loss of or damage to objects: 1,400 SDR
  • In the event of total or partial loss of a vehicle: 8,000 SDR
  • In the event of damage to objects left in the vehicle: 1,400 SDR – the carrier is only liable for damage caused due to errors on its part

§17 Travel insurance and the blue EU health insurance card

In the event of illness arising during the trip, it is the travel participant’s own responsibility to cover all costs for, for example, medical treatment, hospital stay, repatriation, etc. The participants
must bring the blue EU health insurance card, which covers temporary stays of up to 1 year in the EU and EEA countries – i.e. the EU countries as well as Norway, Iceland,
Liechtenstein and Switzerland. With the blue EU health insurance card, you are covered as in the country in question and we recommend that you also take out travel insurance. For travel outside this area, the EU health insurance card does not cover and travel insurance should be taken out. Talk to Naturhelten.dk.

§18 Baggage and baggage insurance

There are baggage restrictions on bus and plane travel. Most often, you can bring 1 suitcase/bag + 1 piece of hand luggage. Ask Naturhelten.dk about the exact rules for your specific trip. Responsibility for ensuring that luggage travels on the correct mode of transport lies with the individual participant. Naturhelten.dk is not responsible for damaged luggage, and it is recommended to take out baggage insurance. Obtain prices and conditions from Naturhelten.dk. If illegal items (e.g., all types of weapons) are brought in luggage, the traveler risks being removed from the bus. In this case, onward travel is at your own arrangement and costs are borne by the traveler.

§19 Member of the Danish Travel Agency Association (DRF)

Naturhelten.dk is a member of the Danish Travel Agency Association, which is a trade association that exclusively includes professional and serious travel agencies that meet specific financial and ethical criteria.

Disputes
If any complaints cannot be resolved amicably, the customer can submit complaints to the Travel Complaints Board, Lyngby Hovedgade 64, 2800 Lyngby.

Choice of law and venue

The travels in this program are all subject to Danish law in all respects and the procedural language is Danish. The venue is Naturhelten.dk’s place of business, XXXX
